The Minnehaha County Sheriff’s Office Civil Division is located on the second floor of the Law Enforcement Center at 320 W. 4th St. in Sioux Falls SD. The phone number is (605) 367-4331.
The Civil Division is comprised of a Sergeant, three deputy sheriffs, one certified civil process server, two office assistants, and seven part-time civil process servers.
The Minnehaha County Sheriff’s Office Civil Division has the responsibility of serving and executing court-issued documents. Among the most common documents served by the Sheriff’s Office include Writs of Possession, Writs of Execution, Distress Warrants, Summons and Complaints, Protection Orders and subpoenas for criminal and civil cases. We also serve other legal documents as received from the Courts, attorneys and private citizens.
There is a sizable portion of Sioux Falls that lies within Lincoln County. The Minnehaha County Sheriff’s Office will only serve to addresses that fall within Minnehaha County. It is the responsibility of the person or entity requesting service (hereafter, referred to as the requestor) to ensure that the address to be served is in Minnehaha County. If our office receives papers that list a service address outside Minnehaha County, our office will still enter the papers into our computer database and research the person to be served to determine if there is a local Minnehaha County address that can be attempted. If the address the requestor provides is in a county surrounding Minnehaha County, our office will accept the papers and enter them into our system for no longer than 30 days in case there is law enforcement contact within Minnehaha County with the person to be served.
If the address is found to be outside of our surrounding area, we will immediately send a return of non-service to the requestor.

All civil paper service fees will need to be prepaid to the Minnehaha County Sheriff’s Office. The fees to be pre-paid will be determined by the type of paper being served (please see chart below). Most paper types require a flat rate of $10 for mileage. There is no mileage fee for any paper service within the Minnehaha County Campus or to an inmate being housed in the South Dakota State Penitentiary located at 1600 North Dr in Sioux Falls, SD.
All fees collected are non-refundable with few exceptions.
If papers are emailed or faxed to our office, there will be an additional fee of $0.25 per page for printing costs. This fee will be collected at the time of the pre-payment for service.
